The most common marijuana offense I see in my practice is Unlawful Possession of Marijuana or UPM. UPM is a violation. It is not a crime and is punishable only by a maximum fine of $100.00 for first time offenders. Despite the light penalty, a person should never plead guilty to a charge of UPM because under New York Criminal Procedure Law, a person charged with UPM is entitled to a dismissal of the charge. Some other low level marijuana offenses may also be dismissed as well.

The most important concern for many of my clients who are charged with a marijuana offense is that a conviction can make a student ineligible for financial aid. Another concern is the fact that some employers or potential employers may take a dim view of marijuana offenders.
