Aggravated Unlicensed Operation of a Motor
Vehicle in the Third Degree (AUO 3rd) NY VTL 511(a)
AUO 3rd is a misdemeanor. It is a
crime punishable up to 30 days in jail (which rarely happens) and
carries a fine up to $500.00. If you are being charged with AUO 3rd you
will need a lawyer to represent you. My office does well helping people
resolve AUO cases favorably. In the typical case, we negotiate a
reduction of the misdemeanor AUO 3rd to a non-criminal traffic
violation that carries less of a fine.
If your license has been suspended or revoked (whether you know it or
not), and you are caught driving, you will be charged with AUO.
While every case is unique, most AUO 3rd defendants' licenses are
suspended for failing to answer a traffic ticket summons, failing to
pay a traffic ticket fine, failing to pay a DMV fee, or letting their
insurance lapse.
Many suspensions are the result of unresolved matters in other courts.

been suspended. In addition to taking care of the AUO 3rd, we will also
appear and represent you in the underlying matter or matters that
caused the suspension.
Our typical AUO 3rd client does not recall being notified that their
license was suspended. When the DMV suspends a license, notice is sent
to the address on record. Unfortunately, many people fail to update the
DMV when they move. In NY, every licensed driver has a legal obligation
to update the DMV when they change their address.
